1. Provider & Scope

By creating an account or purchasing any service through SwipeVera, you agree to be bound by these Terms.

2. Minimum Age Requirement (Strictly 18+)

SwipeVera is strictly intended for individuals who are at least eighteen (18) years of age. By registering or using the service, you represent and warrant that you meet this age requirement. If we discover an account registered by an individual under 18, it will be terminated immediately.

SwipeVera provides digital tools and AI-driven analysis designed to assist users in optimizing their personal dating app profiles (e.g., photo selection feedback, bio generation, prompt suggestions, messaging coaching, and date planning itineraries).

Independent Service: SwipeVera is an independent service and is not affiliated with, sponsored by, or partnered with Tinder, Hinge, Bumble, or any other dating application.

4. User Accounts & Registration

To access certain features and save your generated assets, you must create a user account. You agree to provide accurate and complete registration information and maintain the security and confidentiality of your login credentials. You are responsible for all activities that occur under your account.

6. Purchases, Entitlements & Separate Usage Credits

To provide transparency and fair consumption, SwipeVera separates product entitlements from usage generation credits:

• Entitlement / Access: Unlocking a paid tier grants you permanent access to view the corresponding module features in your dashboard.
• No Charge for Viewing: Viewing or reviewing previously generated results, analyses, bios, or photos never consumes new credits.
• Failed Generation Protection: If a technical generation fails due to a server error or AI interruption, the corresponding credit is not permanently deducted.
• Account Bound: Purchased credits and entitlements are linked directly to your authenticated user account and are non-transferable unless applicable law requires otherwise.

7. Repeat Purchases & Balance Top-ups

All purchases are one-time payments (no recurring subscriptions). If you have exhausted your usage credits (e.g. photo generations or profile regenerations), you may purchase additional packages or upgrades at the prevailing rate shown at checkout.

9. Uploaded Content & User Warranties

You retain all ownership rights in the photographs, screenshots, and texts you upload to SwipeVera. By uploading content, you grant us a limited, worldwide, non-exclusive license solely for the purpose of processing, analyzing, and synthesizing the requested profile outputs.

You warrant that you own or have obtained all necessary licenses, rights, consents, and permissions to submit the uploaded content, and that such content does not infringe the privacy, publicity, or intellectual property rights of any third party.

10. AI Photo Pack Specific Terms

The AI Photo Pack creates synthetic visual representations based on your uploaded facial reference photos. You agree to use AI-generated photos responsibly. You must not use generated photos to impersonate other individuals, deceive others in harmful ways, or create misleading representations intended to harass or defraud.

11. Prohibited Uses & Conduct

You agree not to use SwipeVera to:

• Upload photographs or personal data of any third party without explicit authorization
• Impersonate any person or entity or misrepresent your identity
• Submit content that is illegal, defamatory, obscene, harassing, or discriminatory
• Attempt to reverse-engineer, decompile, scrape, or extract source code or underlying AI models
• Interfere with or disrupt the security or performance of our servers and edge functions
• Use automated scripts or bots to access or manipulate the platform

12. System Availability & Technical Failures

We strive to provide uninterrupted service availability. However, temporary interruptions may occur due to essential maintenance, system upgrades, third-party network outages, or API disruptions from upstream AI providers. Where a technical failure prevents the delivery of a purchased generation, we will restore the affected credit or assist via customer support.

13. Statutory Consumer Rights & Right of Withdrawal

Nothing in these Terms excludes, limits, or restricts any mandatory statutory consumer rights, warranty claims, or withdrawal rights applicable to you under European Union or national consumer protection legislation. 14. Limitation of Liability

We are liable without limitation for intent and gross negligence, as well as for damages resulting from injury to life, body, or health in accordance with statutory law. In cases of slight negligence, we are only liable for the breach of essential contractual obligations (cardinal duties), limited to foreseeable, typically occurring damages. The provisions of the German Product Liability Act (ProdHaftG) remain unaffected.

15. Account Suspension & Termination

We reserve the right to temporarily suspend or permanently terminate user accounts in the event of serious or repeated violations of these Terms (such as uploading unauthorized third-party photos, engaging in harassment, or fraudulent payment activity), giving appropriate prior notice where feasible.

16. Account Deletion

You may delete your account at any time via Account Settings (/settings). Upon deletion, all associated active profile data and credits are removed in accordance with our Privacy Policy.

17. Changes to Services & Terms

We may update these Terms from time to time to accommodate technical developments or legislative changes. In the event of material changes affecting existing accounts, we will notify registered users with reasonable advance notice.

18. Governing Law & Jurisdiction
